Intellectual Property Rights

Subject to these Terms and your timely payment of any applicable fees, Always Be Trekking grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and view the Website and its Content solely for your personal, non-commercial use. This license does not grant any ownership rights in the Website or its Content.

Restrictions on Use

Unless expressly permitted by Always Be Trekking in writing, you may not:

Termination, Suspension and Continued Access

Access to the Website and any Content is conditioned upon purchasing a Membership. If you fail to pay the fees for a given period, your license for that period will be automatically suspended, and no access or license will be granted for the unpaid period. Access will automatically resume for future periods upon timely payment of the applicable fees for those periods. 

Third-Party Content

Certain materials available on the Website may include content owned by third parties or links to third-party websites or services. Such content remains the property of its respective owners and may be subject to additional terms and conditions imposed by those third parties.

Always Be Trekking does not claim ownership over third-party content and makes no warranties regarding its accuracy, completeness, or availability.

Submitted Content

If the Website allows you to submit comments, feedback, messages, photographs, or other materials (“User Content”), you represent and warrant that you have all necessary rights to submit such materials. By submitting User Content, you grant Always Be Trekking a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, display, publish, distribute, and adapt such content for the purpose of operating, promoting, and improving the Website, its Content or other Services. Always Be Trekking reserves the right, but not the obligation, to review, remove, or modify User Content that violates these Terms or applicable laws.

Membership and Payment

Membership Access

Entire Content on the Website is available only to users who purchase a paid membership (the “Membership”). By purchasing a Membership, you are granted a limited, non-exclusive, non-transferable, and revocable right to access and view the Content available on the Website during the applicable Membership Term, strictly for your personal and non-commercial use and in accordance with these Terms.

Membership Plan and Fees

The Website currently offers an “Annual Membership Plan“, which provides access to all Content available on the Website. The plan may also include newsletters with the content updates, if Always Be Trekking chooses to send them. All applicable fees are displayed on the Website at the time of purchase. By purchasing a Membership, you agree to pay the applicable membership fee and any applicable taxes.

Membership Term and Renewal

The Membership begins on the date the purchase is successfully completed (the “Start Date”) and remains valid for a period of one (1) year. Unless cancelled before the end of the current Membership Term, the Membership will automatically renew for successive one-year periods, and the applicable membership fee will be charged to the payment method used during the original purchase.

You may cancel your Membership at any time before the renewal date to prevent automatic renewal.

Payment Processing

Payments are processed through third-party payment providers. By submitting payment information, you represent that you are authorized to use the designated payment method and authorize the Website and its payment processors to charge the applicable membership fee.

Suspension for Non-Payment

If a payment for a renewal Membership cannot be successfully processed, we reserve the right to suspend or terminate access to Content until payment is successfully completed.

Changes to Membership Fees

Always Be Trekking may change the membership fee or other payment terms from time to time. Any such changes will be communicated to members at least 30 days in advance. By continuing your Membership after the change takes effect, you agree to the updated fees and terms. If you do not agree with the changes, you may cancel your Membership before the renewal date.

Taxes and Additional Charges

All membership fees are exclusive of applicable taxes, duties, or other governmental charges, which are your responsibility. Any bank fees, transfer costs, or other charges related to payment of the membership fees are also your responsibility.

Return and Refund Policy

By placing an order or making a purchase at Always Be Trekking, you agree that:

• Refunds are NOT given for any purchases made. 

Links to Other Websites

These Terms applies only to the Website, Content and Service. The Website may contain links to other websites not operated or controlled by Always Be Trekking. We are not responsible for the content, accuracy or opinions expressed in such websites, and such websites are not investigated, monitored or checked for accuracy or completeness by us. Please remember that when you use a link to go from our Website to another website, our Terms are no longer in effect. Your browsing and interaction on any other website, including those that have a link on our Website, is subject to that website’s own rules and policies. Such third parties may use their own cookies or other methods to collect information about you. 

Membership Account

When you create a membership account to access our Content or Service, you must provide information that is accurate, complete, and up-to-date at all times. Failure to do so constitutes a breach of these Terms, which may result in immediate suspension or termination of your account. You are responsible for safeguarding your password and for all activities that occur under your account, whether your password is associated with our services or a third-party social media service. You agree not to disclose your password to any third party. You must notify us immediately if you become aware of any breach of security or unauthorized use of your account.

To make a payment, you must provide accurate and complete information, including your name, email, billing details, and payment information. You represent and warrant that you have the legal right to use the payment method provided and that all information is true and correct. By submitting this information, you authorize Always Be Trekking to share it with third-party payment processors to complete the payment.

Modifications to Our Website

Always Be Trekking reserves the right to modify, suspend or discontinue, temporarily or permanently, the Website or any Service to which it connects, with or without notice. Always Be Trekking does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third-Party Services.

Third-Party Services and links thereto are provided solely as a convenience to you and you access and use them entirely at your own risk and subject to such third parties’ terms and conditions.

Term and Termination

These Terms remain in effect for as long as your Membership is active and apply until your Membership is cancelled or terminated.

Termination by Member

You may cancel your Membership at any time. Cancellation will take effect at the end of your current Membership Term. All fees already paid are non-refundable. You will retain access to premium content until the expiration of your Membership Term.

Termination by Always Be Trekking

Always Be Trekking may suspend or terminate your Membership, with reasonable notice, if required by law or regulation, or if Always Be Trekking reasonably determines that your use of the Website, Content, or Services violates these Terms or could harm the Website, its operations, or other users.

Termination for Breach

Membership may be terminated immediately, without any notice, if you violate these Terms, including but not limited to: failure to pay membership fees or violation of intellectual property rights.

Effect of Termination

Upon termination of your Membership for any reason, your access to premium content will end. No fees already paid will be refunded.

Indemnification

You agree to indemnify and hold Always Be Trekking and its parents, subsidiaries, affiliates, directors, officers, employees, agents, partners and licensors (if any) harmless from any claim or demand, including reasonable attorneys’ fees, due to or arising out of your: (a) use of the Website; (b) violation of Intellectual Property and License section of these Terms; c) any other violation of these Terms or any law or regulation (including Privacy Policy and any Additional Terms); or (d) violation of any right of a third party.

No Warranties

The website is provided to you “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Always Be Trekking, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Website, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, Always Be Trekking provides no warranty or undertaking, and makes no representation of any kind that the Website will meet your requirements, achieve any intended results, be compatible or work with any other software, websites, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither Always Be Trekking nor any Always Be Trekking’s provider makes any representation or warranty of any kind, express or implied: (i) as to the operation, availability or uptime of the Website, or the information, Content, and materials or products included thereon; (ii) that the Website will be uninterrupted or error-free, including any temporary interruptions or minor errors that may occur due to the nature of online platforms; (iii) as to the accuracy, reliability, or currency of any information or Content provided through the Website; or (iv) that the Website, its servers, the Content, or e-mails sent from or on behalf of Always Be Trekking are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components. The limitations, exclusions, and disclaimers in this section apply to the fullest extent permitted by law. 

By accessing or using the Website, its Content, and Services, you acknowledge and agree that you do so at your own discretion and risk. Limitation of Liability

Notwithstanding any damages that you might incur, the entire liability of Always Be Trekking, its affiliates and any of its suppliers under any provision of these Terms and your exclusive remedy for all of the foregoing shall be limited to the total amount actually paid by you for the Membership during the six (6) months immediately preceding the event giving rise to the claim.

Because some jurisdictions do not allow the exclusion or limitation of certain damages, Always Be Trekking’s liability in such jurisdictions shall be limited to the greatest extent permitted by applicable law. In addition, because some jurisdictions do not permit the disclaimer of certain warranties or other provisions set forth above, all such disclaimers may not apply to you to the extent prohibited by applicable law.

Communications

Always Be Trekking may send you emails or other communications regarding the Website, its Content or Service, including updates, new blog posts, enhancements, new features, or other service-related information. Promotional or marketing messages may also be included. You may opt out of promotional communications by following the unsubscribe instructions provided in such messages.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

No failure to exercise, and no delay in exercising, on the part of either party, any right or any power under these Terms shall operate as a waiver of that right, remedy or power. Nor shall any single or partial exercise of any right, remedy or power under these Terms preclude further exercise of that or any other right granted herein. Any waiver of any provision of these Terms shall be effective only if made in these Terms or made in writing and signed by an authorized representative of the party granting such waiver. Any waiver shall apply only to the specific instance for which it is given. A waiver of any breach shall not constitute a waiver of any subsequent breach.  

YOU AND Always Be Trekking AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE WEBSITE, MEMBERSHIP AND SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED. This limitation does not apply to any proceedings or claims related to intellectual property rights.

Amendments to these Terms

Always Be Trekking reserves the right, at its sole discretion, to modify or replace these Terms at any time. Always Be Trekking may make non-material changes to these Terms at any time without notice. You are responsible for reviewing these Terms regularly, as any changes become effective immediately upon posting on Website, and you will be deemed to accept and agree to the updated Terms by continuing to access and use of Website, Content or Service, after such changes are posted. If a revision is material Always Be Trekking will provide at least thirty (30) days’ prior notice before the updated Terms take effect. What constitutes a material change will be determined at our sole discretion.

Always Be Trekking may also implement changes without advance notice where it introduces new services, operations, or technologies, or where urgent changes are necessary to address misuse, security issues, prevent harm, or comply with legal or regulatory obligations.

Typographical Errors

In the event a product and/or service is listed at an incorrect price or with incorrect information due to typographical error, we shall have the right to refuse or cancel any orders placed for the product and/or service listed at the incorrect price. We shall have the right to refuse or cancel any such order whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account or other payment account in the amount of the charge.

Miscellaneous

Always Be Trekking will be entitled to injunctive or other equitable relief (without the obligations of posting any bond or surety) in the event of any breach or anticipatory breach by you. Always Be Trekking operates and controls the Always Be Trekking Service from its offices in United States. The Service is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation.
